At BAAB Writing and Marketing Services ("PRO", "we", "our", or "us"), we're committed to providing a safe, responsible, and ethical AI-powered content creation platform. This Acceptable Use Policy ("AUP") applies to all users of the PRO platform and services (collectively, the "Platform") and sets forth the rules and restrictions governing your use of the Platform.

This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined in this AUP have the meanings given to them in our Terms of Service.

By accessing or using the Platform, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account, as set forth in our Terms of Service.

Your Responsibilities

You are solely responsible for:

  • All content you create, generate, distribute, or publish using the Platform
  • Ensuring that your use of the Platform complies with all applicable laws, regulations, and these policies
  • Any consequences arising from content you create or distribute using the Platform
  • Reviewing, verifying, and validating all AI-generated content before use, publication, or distribution

PRO provides tools for content creation, but you retain full responsibility for how you use those tools and the content you create.

Prohibited Content and Activities

You may not use the Platform to create, generate, distribute, publish, or facilitate any of the following:

1. Illegal Activities

Content or activities that:

  • Violate any applicable local, state, national, or international law or regulation
  • Promote, facilitate, or provide instructions for illegal activities
  • Involve illegal goods or services (including but not limited to illegal drugs, weapons, explosives, counterfeit goods, or stolen property)
  • Constitute or facilitate fraud, scams, phishing, or deceptive practices
  • Violate export control laws or economic sanctions
  • Involve money laundering, terrorist financing, or other financial crimes

2. Harmful or Dangerous Content

Content that:

  • Promotes, encourages, or provides instructions for violence, terrorism, or harm to individuals or groups
  • Encourages or provides instructions for self-harm, suicide, or eating disorders
  • Promotes dangerous or harmful activities that could result in physical injury
  • Contains instructions for creating weapons, explosives, or other dangerous materials
  • Threatens, intimidates, or incites violence against any person or group
  • Promotes or glorifies acts of terrorism or violent extremism

3. Hateful, Discriminatory, or Harassing Content

Content that:

  • Promotes hate speech, discrimination, or prejudice based on race, ethnicity, national origin, religion, caste, sexual orientation, gender, gender identity, age, disability, or any other protected characteristic
  • Harasses, bullies, intimidates, degrades, shames, or victimizes any individual or group
  • Promotes supremacist ideologies or groups
  • Contains slurs, epithets, or derogatory language targeting protected groups
  • Incites hatred or violence against individuals or groups based on protected characteristics

4. Child Safety and Exploitation

Content that:

  • Exploits, sexualizes, endangers, or harms children or minors in any way
  • Contains child sexual abuse material (CSAM) or any sexual content involving minors
  • Promotes child exploitation, grooming, or trafficking
  • Depicts minors in sexual, suggestive, or exploitative contexts
  • Facilitates contact between adults and minors for inappropriate purposes
Zero-Tolerance Policy: This is our zero-tolerance policy. Any violation will result in immediate account termination and reporting to law enforcement authorities.

5. Sexually Explicit or Exploitative Content

Content that:

  • Contains pornographic or sexually explicit material
  • Promotes prostitution, sex trafficking, or sexual exploitation
  • Non-consensually shares intimate or sexual images (including "deepfakes" or manipulated images)
  • Promotes sexual services or solicitation
  • Sexualizes individuals without their consent

6. Deceptive, Fraudulent, or Misleading Content

Content that:

  • Impersonates any person, organization, or entity, or falsely represents affiliation with any person or organization
  • Contains false, misleading, or deceptive information intended to manipulate or deceive others
  • Constitutes phishing, pretexting, or social engineering attacks
  • Spreads disinformation, propaganda, or coordinated inauthentic behavior
  • Falsely represents the origin, source, or authenticity of content
  • Creates or distributes deepfakes or manipulated media without clear disclosure
  • Misrepresents AI-generated content as human-created when disclosure is required by law or ethical standards

7. Spam and Malicious Content

Content that:

  • Constitutes spam, unsolicited bulk messages, or automated mass communications
  • Contains malware, viruses, trojans, ransomware, or other malicious code
  • Exploits vulnerabilities in computer systems or networks
  • Facilitates hacking, cracking, or unauthorized access to systems or data
  • Involves distributed denial-of-service (DDoS) attacks or similar disruptive activities
  • Contains scripts or code designed to damage, interfere with, or secretly intercept systems or data

8. Intellectual Property Violations

Content that:

  • Infringes or misappropriates third-party copyrights, trademarks, patents, trade secrets, or other intellectual property rights
  • Plagiarizes content or closely imitates proprietary materials without authorization
  • Uses protected brand names, logos, or intellectual property without permission
  • Facilitates piracy or unauthorized distribution of copyrighted works
  • Circumvents digital rights management (DRM) or technological protection measures

9. Privacy Violations

Content that:

  • Violates the privacy rights of others
  • Shares personal information, contact details, or private data of others without consent (doxxing)
  • Uses personal information in violation of applicable privacy laws or regulations
  • Facilitates unauthorized surveillance or stalking
  • Discloses confidential or proprietary information without authorization

10. Manipulative or Exploitative Commercial Content

Content that:

  • Promotes pyramid schemes, multi-level marketing scams, or fraudulent investment opportunities
  • Contains false or misleading advertising or marketing claims
  • Manipulates users into making purchases or financial decisions through deceptive tactics
  • Exploits vulnerable populations (e.g., children, elderly, disabled individuals) for commercial gain
  • Promotes predatory lending, exploitative financial products, or unfair business practices

11. Misinformation in Critical Areas

Content that spreads demonstrably false information about:

  • Public health or medical treatments that could cause physical harm (e.g., dangerous "cures," anti-vaccine misinformation)
  • Election integrity, voting processes, or election results intended to suppress voter participation or undermine democratic processes
  • Climate science or environmental issues that contradicts established scientific consensus and could lead to harmful actions
  • Natural disasters or emergencies that could endanger public safety

12. Unauthorized Professional Services

Content that:

  • Provides unlicensed medical, legal, or financial advice
  • Misrepresents professional qualifications or credentials
  • Offers services requiring professional licensure without proper authorization
  • Substitutes for professional consultation in areas where professional judgment is required
Note: While PRO may be used to draft content related to these fields, you must ensure all content is reviewed and approved by licensed professionals before use, and you must disclose that AI assisted in content creation where required.

Platform Misuse

You may not:

1. Abuse Platform Features

  • Attempt to circumvent, disable, or interfere with security features or access controls
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms of the Platform
  • Use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks
  • Use automated tools (bots, scrapers, crawlers) to access the Platform without authorization
  • Create multiple accounts to evade restrictions or obtain additional free-tier benefits
  • Share account credentials or allow unauthorized access to your account

2. Develop Competing Products

  • Use the Platform to develop, train, or improve competing AI products or services
  • Extract, harvest, or scrape data from the Platform to build competing services
  • Reverse-engineer our AI models or algorithms for competitive purposes

3. Violate Rate Limits or Restrictions

  • Exceed usage limits, rate limits, or quotas specified in your subscription plan
  • Attempt to bypass or circumvent technical limitations or restrictions
  • Use the Platform in a manner that generates excessive API calls or system load

4. Interfere with Other Users

  • Interfere with or disrupt other users' access to or use of the Platform
  • Upload or transmit content that contains viruses or harmful code that could affect other users
  • Engage in activities that negatively impact Platform performance for others

Compliance Requirements

1. Legal Compliance

You must:

  • Comply with all applicable local, state, national, and international laws and regulations
  • Obtain all necessary licenses, permits, and authorizations for your business activities
  • Comply with advertising standards and consumer protection laws
  • Honor intellectual property rights and obtain necessary permissions for content use

2. Regulated Industries and Professional Services

If you provide legal, medical, financial, or other professional advice or services:

  • All AI-generated content must be reviewed and approved by a licensed professional before publication or distribution
  • You must disclose to clients when AI has assisted in content creation, where required by professional ethics rules or regulations
  • You must maintain all required professional licenses and insurance
  • You must comply with all applicable professional standards and regulations

3. Automated Services and Chatbots

If you deploy AI-generated content in automated systems or chatbots:

  • You must clearly disclose to end users that they are interacting with an AI system, not a human
  • You must implement appropriate safeguards to prevent misuse
  • You must provide a clear way for users to reach a human when necessary
  • You must comply with all applicable laws regarding automated communications and consumer protection

4. Marketing and Advertising

When using the Platform for marketing or advertising purposes:

  • All claims must be truthful, accurate, and substantiated
  • You must comply with FTC guidelines, CAN-SPAM Act, GDPR, and other applicable advertising regulations
  • You must include required disclosures and disclaimers
  • You must honor opt-out requests and maintain proper consent records

Content Review and AI Limitations

1. Your Obligation to Review

You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or "hallucinations" (false or fictional information)
  • You are solely responsible for reviewing, fact-checking, and verifying all AI-generated content before use
  • PRO does not guarantee the accuracy, completeness, reliability, or appropriateness of any Output
  • You must validate that content complies with applicable laws, professional standards, and ethical guidelines

2. High-Risk Use Cases

You must exercise extra caution and implement additional review procedures when using the Platform for:

  • Medical or health-related content
  • Legal documents or advice
  • Financial advice or investment recommendations
  • Content affecting public safety or welfare
  • Content targeting vulnerable populations
  • Time-sensitive or emergency communications

3. Cultural Sensitivity

While PRO is designed to be culturally intelligent, you remain responsible for:

  • Ensuring content is appropriate for your target audience and cultural context
  • Avoiding culturally insensitive, offensive, or inappropriate content
  • Reviewing content for cultural nuances that AI may miss
  • Adapting content as necessary for different markets and audiences

Reporting Violations

1. How to Report

If you become aware of content or activity that violates this AUP, please report it immediately to:

2. Our Response

We will:

  • Report illegal activity to appropriate law enforcement authorities
  • Cooperate with law enforcement investigations

3. Good Faith Reporting

We will not retaliate against users who report violations in good faith. However, we reserve the right to take action against users who make false, malicious, or abusive reports.

Enforcement and Consequences

1. Violations

If we determine that you have violated this AUP, our Terms of Service, or applicable laws, we may, in our sole discretion:

  • Issue a warning
  • Require you to remove or modify violating content
  • Temporarily suspend your account
  • Permanently terminate your account
  • Limit your access to certain features
  • Refuse to provide services to you in the future
  • Report violations to law enforcement or regulatory authorities
  • Take legal action to enforce our rights or protect others

2. Immediate Termination

We reserve the right to immediately terminate accounts without warning for:

  • Content involving child exploitation or abuse
  • Terrorism or violent extremism
  • Illegal activities that pose imminent harm
  • Coordinated abuse or platform manipulation
  • Repeated or egregious violations of this AUP

3. No Refunds

Account termination for AUP violations will result in forfeiture of any remaining subscription period, and no refunds will be provided.

4. Cooperation with Authorities

We cooperate with law enforcement and regulatory authorities. We may preserve and disclose account information and content when required by law or when we believe disclosure is necessary to:

  • Comply with legal obligations or respond to legal process
  • Protect the rights, property, or safety of PRO, our users, or the public
  • Detect, prevent, or address fraud, security, or technical issues
  • Enforce our Terms of Service or this AUP

Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect:

  • Changes in legal or regulatory requirements
  • Evolution of Platform features and capabilities
  • Emerging threats or misuse patterns
  • Community feedback and best practices

When we make material changes, we will:

  • Update the "Last Updated" date at the top of this policy
  • Notify you via email or through a notice on the Platform
  • Provide you a reasonable opportunity to review the changes

Your continued use of the Platform after changes become effective constitutes acceptance of the updated AUP. If you do not agree to the changes, you must stop using the Platform.

By accessing or using PRO (Pitch. Respond. Offer.)®, our AI-human hybrid sales and marketing platform, including our AI copywriter AiPRO, human copywriting services, image generation tools, and related services (collectively, the "Platform"), you agree to be legally bound by these Terms of Service ("Terms"). These Terms are entered into with BAAB Writing and Marketing Services ("PRO", "we", "our", or "us").

1. Registering and Accessing the Platform

1.1 Accepting the Terms

You agree to these Terms on behalf of yourself as an individual and, if acting on behalf of a business or entity, on behalf of that business or entity (in either case, "you", "your"). You represent and warrant that you have the legal authority and capacity (including being of legal age) to accept these Terms and to bind such business or entity to these Terms. We may modify these Terms from time to time and will provide notice of such modifications by any reasonable means, including by posting revised Terms through our website. Any modifications will not apply retroactively and will become effective immediately upon posting. The "Last Updated" legend above indicates when these Terms were last modified. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of such modifications. If you do not agree to these Terms or any modifications thereto, you must immediately cease using the Platform and terminate this Agreement.

1.2 Registration

You may be required to register to access or use all or part of the Platform. During registration, you must comply with our procedures and provide certain information, including contact and identification information. Any registration information you provide must be accurate, complete, and current, and you shall promptly notify us of any changes to such information. You acknowledge and agree that we may use your registration information to contact you in connection with these Terms, including notifications of updates to the Platform. You must be at least thirteen (13) years of age to access or use the Platform. If you are between thirteen (13) and eighteen (18) years of age, you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. PRO does not knowingly collect personal information from individuals under thirteen (13) years of age without verifiable parental consent.

1.3 Access Credentials

Upon registration, we will issue certain access credentials to enable access to the Platform, including a username, password, and API key as applicable. Your access credentials are for your use only and must be maintained in strict confidence. You shall not sell, share, transfer, sublicense, or otherwise make your access credentials available to any third party, nor shall you misrepresent your credentials when accessing or using the Platform. You are solely responsible for any and all use or misuse of your access credentials.

2. Using the Platform

2.1 Service Tiers

PRO provides two service tiers: (a) self-service access to AiPRO (our AI copywriter) for independent content creation; and (b) human-assisted plans combining AI generation with professional human copywriting support. Your specific rights and access to features are determined by your selected subscription tier.

2.2 Account Sharing and Team Access

Your account is licensed for use by you and authorized team members within your organization only, as specified in your subscription plan. You shall not share account access with unauthorized persons or persons outside your organization. Higher-tier subscription plans may include additional user seats for team members. Sharing access credentials with persons outside your organization or with unauthorized third parties is strictly prohibited and may result in immediate suspension or termination of your account.

2.3 License Grant

Subject to and conditioned upon your strict compliance with these Terms, PRO grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right and license during the Term to: (i) access and use the Platform solely for your internal business purposes; (ii) generate marketing content, including copy, images, and campaigns, through the Platform; (iii) use Output (as defined below) in connection with your business operations; and (iv) permit authorized team members within your organization to access the Platform under your account where your subscription tier permits such access.

2.4 Ownership

As between you and PRO, PRO owns and retains all right, title, and interest in and to the Platform, including without limitation AiPRO, our artificial intelligence models, algorithms, technology, intellectual property rights, and any modifications or improvements thereto. Subject to the foregoing, as between you and PRO, you own all right, title, and interest in and to your business and brand. Except as expressly provided in these Terms, (i) PRO grants no rights or licenses, whether express or implied, under any intellectual property rights, and (ii) neither party shall acquire any right, title, or interest in or to any property of the other party under these Terms. All rights and licenses not expressly granted herein are expressly withheld and reserved.

2.5 Feedback

If you provide PRO with any ideas, proposals, suggestions, recommendations, or other materials related to the Platform or any of our technology, data, business operations, or systems ("Feedback"), you hereby grant to PRO and its affiliates a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, fully sublicensable (through multiple tiers), transferable, and assignable right and license to reproduce, distribute, publicly display, publicly perform, modify, create derivative works of, commercialize, and otherwise use and exploit such Feedback for any and all purposes without any obligation or compensation to you.

2.6 Support

PRO may, in its sole discretion, provide technical support and services to you in connection with the Platform. PRO may modify, suspend, or discontinue such support or services at any time, for any reason, without any obligation or liability to you.

2.7 Third-Party Services

You may elect to use third-party products, software, services, or materials ("Third-Party Services") in connection with your use of the Platform. Your use of any Third-Party Services is governed solely by the applicable third-party terms and conditions for such Third-Party Services. PRO is not responsible for any Third-Party Services or for your use thereof.

2.8 Beta Features

You may be provided access to certain features or functionality of the Platform designated as early access, preview, or beta testing ("Beta Features"). Beta Features are offered for purposes of testing, evaluation, and improvement of the Platform and may have different privacy, security, or compliance commitments than generally available features. Beta Features may not be error-free, and content generated through Beta Features may be subject to loss, damage, or third-party licenses.

2.9 Free Tier

If you are using a free tier or free trial of the Platform, you shall not create multiple accounts to obtain additional benefits under such free offering. We reserve the right to charge standard rates, or suspend or terminate your access to the Platform, if we determine in our sole discretion that you are not using the free tier in good faith or in compliance with these Terms.

3. Usage Requirements

In using the Platform, you (and anyone acting on your behalf or through your account):

3.1 Permitted Use

You shall:

  • Use the Platform in compliance with all applicable laws, regulations, these Terms, our Acceptable Use Policy, the Documentation (as defined below), and any other agreements you may have with third parties
  • Use the Platform solely for lawful business purposes and in a manner that does not infringe, misappropriate, or violate any third-party intellectual property or proprietary rights
  • Comply with our Acceptable Use Policy, which is incorporated into these Terms by reference
  • Use the Platform in compliance with any rate limits, usage limits, or other restrictions that may be established by us from time to time
  • Maintain accurate and current account and billing information
  • Use the Platform only in countries, regions, or territories currently supported by PRO

3.2 Prohibited Use

You shall not:

  • Use the Platform to create, generate, distribute, or publish any content prohibited by our Acceptable Use Policy, including but not limited to illegal, harmful, deceptive, discriminatory, or harassing content
  • Use the Platform to reverse-engineer competitors' marketing strategies or create content that plagiarizes or closely imitates competitors' proprietary marketing materials
  • Reproduce, modify, adapt, translate, create derivative works of, sell, offer to sell, lend, distribute, provide access to, or otherwise exploit any portion of the Platform except as expressly authorized in Section 2.3
  • Reverse engineer, decompile, disassemble, translate, or otherwise attempt to discover the source code, underlying components, models, algorithms, or systems of any portion of the Platform
  • Harvest, scrape, or collect data from the Platform or from PRO's or its affiliates' software, algorithms, models, or systems
  • Create any software that functions substantially similarly to any portion of the Platform for use as a replacement for the Platform or for provision to third parties
  • Use the Platform to develop, train, or improve competing products or services
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notice appearing on or contained within the Platform
  • Interfere with or attempt to interfere with the proper functioning of the Platform
  • Buy, sell, share, transfer, or otherwise make available your access credentials to any third party, or allow third parties to access or use the Platform through your account without PRO's prior written consent
  • Provide access to, distribute, or make publicly available any portion of the Platform to third parties
  • Cause or permit any third party to engage in any of the foregoing without PRO's prior written consent

4. Commercial Use Restrictions

Your permitted use of the Platform depends on your access level:

Free Users and Starter Plan Users: If you access or use the Platform without charge or under a "Starter Plan," you may use the Platform only for non-commercial, evaluation purposes.

Paid Subscribers: If you access or use the Platform through a paid subscription plan at the tier designated for commercial use or above, you may use the Platform for commercial purposes in accordance with your subscription tier.

In all cases, your access to and use of the Platform, including any Output generated through the Platform, must comply with our Acceptable Use Policy and all other applicable terms set forth herein.

We're committed to protecting your privacy. This Privacy Policy explains how BAAB Writing and Marketing Services ("PRO", "we", "our", or "us") collects, uses, shares, and protects your personal information when you use the PRO platform and services (collectively, the "Platform").

1. Information We Collect

We collect several types of information from and about users of our Platform:

1.1 Information You Provide Directly

Account Information: When you register for an account, we collect your name, email address, phone number (optional), billing address, and password.

Payment Information: When you subscribe to a paid plan, we collect payment card information, billing address, and other payment details necessary to process your subscription. Payment information is processed securely through our third-party payment processors and is not stored on our servers.

Your Content: We collect the content you provide to the Platform, including:

  • Input: Text, data, information, images, and other content you submit to AiPRO or request from our human copywriting services
  • Output: AI-generated copy, images, and content produced by the Platform in response to your Input
  • Training Data: Information you provide to customize AiPRO, including your industry, target audience, brand voice preferences, words to use or avoid, and tone settings
  • Voice Recordings: If you use voice command features, we process voice recordings to generate content (voice recordings are not permanently stored unless you opt in)

Communications: Messages, feedback, ratings, support requests, and other communications you send to us.

Profile Information: Optional information you provide to enhance your experience, such as company name, website, industry, and marketing preferences.

1.2 Information We Collect Automatically

Device Information: Device type, operating system, browser type and version, device identifiers, and IP address.

Usage Information: How you interact with the Platform, including pages viewed, features accessed, content created, time spent on the Platform, referring/exit pages, and clickstream data.

Performance Data: Technical information such as log files, error reports, diagnostics data, and performance metrics.

Location Information: General geographic location based on your IP address.

1.3 Information from Cookies and Similar Technologies

2.2 Training Our AI Models

Our Training Commitment: We take your privacy seriously and are transparent about how we use your content for AI training.

Currently, we do NOT use your Input or Output to train our AI models, except in the following limited circumstances:
